The Police Service Commission, PSC, has debunked reports that Abba Kyari, the embattled Commander of the Intelligence Response Team (IRT), has been reinstated to his position in the Police after he was suspended on July 31, following his indictment by the Federal Bureau of Investigation, FBI.

What necessitated the response from PSC is the spreading of reports that Kyari had been secretly recalled by Inspector General of Police (IGP) Usman Baba.

A member of the PSC, Mr. Austine Braimoh, disclosed that Kyari is still under investigation.

The PSC member said Kyari had not been reinstated, adding that the IGP can only recommend to the commission steps to take, while it has the final say on the issue.

He said: “We are not aware (that Kyari has been reinstated). If he is going to be reinstated, they have to write to us. We placed him on suspension. The IGP wrote to us about what he did and we had to place him on suspension until he is cleared or indicted.

“We are yet to receive any report that he has been cleared or indicted. So, there is no way the commission can reinstate him into service without an official report on him. IGP can recommend to the commission and we will now do the needful.”

Also, reacting to the development, the Force Headquarters spokesman Frank Mba, a Commissioner of Police (CP), said the IGP cannot unilaterally reinstate Kyari.

He said: “The powers to exercise disciplinary control over officers of the cadres of Abba Kiyari are the exclusive and statutory responsibility of the Police Service Commission (PSC). All inquiries on the issues of reinstatement should be directed to the PSC.”

What Will Happen To Abba Kyari According To Minister Of Police Affairs

According to the Minister of Police Affairs, Muhammad Dinyadi, Abba Kyari’s case has been submitted to the Attorney-General of the Federation, Abubakar Malami for advice on the next step to take.

He further said that the issue of the embattled deputy commissioner of police has actually got to the public domain.

The minister said: ”Now, everybody has heard that the police, in their very wisdom and very usual way of becoming very transparent and being fair to all, has set up a committee to investigate all these allegations.

“And we have also reported that the committee has submitted the report to the IGP, and we have submitted this report and recommendations to the AGF for a legal opinion. Thereafter, we will take it to Mr. President for final consideration. So, you can see that this matter is a local matter here; it also has some international connotations. So, we have to do some due diligence to ensure that we do the right thing.

“There has to be some consultation with the ministry of foreign affairs and ministry of justice before a final decision is taken. What is important is that Nigerians should know that the police management is up and doing, and they have done what they are supposed to do. I hope people will wait and see what action is going to be taken on this matter.

“The investigation is supposed to be done by the police because he is their staff. We have informed the Police Service Commission, and they have directed that the officer be suspended from duty, pending the outcome of the investigation.

“By the time we finish this thing, we’ll refer what is needed to be referred to the Police Service Commission for final action. So, I think it is the police who have the responsibility to investigate.”

How Abba Kyari Defended Himself Against Allegations

Abba Kyari in his reaction to the allegations leveled against him by the FBI pleaded his innocence, saying he collected no bribe from the famed suspected internet fraudster, Hushpuppi.

In a statement, Abba Kyari explained that “We traced and arrested the Suspect and after investigations, we discovered there wasn’t an actual threat to anyone’s life And they are longtime friends who have money issues between them hence we released the Suspect on bail to go and he was not taken to any jail.

”Hushpuppi called our office about 2years ago that somebody in Nigeria Seriously threatened to kill his Family here in Nigeria and he sent the person’s Phone number and pleaded we take action before the Person attacks his family.

“Nobody demanded a kobo from Abbas Hushpuppi. Our focus was to save people’s lives that were purported to have been threatened.

“We responded to a distress call he made on a threat to his family and released the Suspect when we discovered there was no life threat from the Suspect, Vincent is alive and can be contacted.”

Court Rejects Application To Stop Abba Kyari’s Extradition Process

In August, the Federal High Court in Abuja refused to grant an ex parte application to restrain the Nigeria Police Force (NPF) and the Attorney-General of the Federation (AGF) from arresting and extraditing Kyari.

Justice Ahmed Mohammed rejected the application filed by the Incorporated Trustees of Northern Peace Foundation.

The foundation had through its legal team led by Dr. Olukayode Ajulo in an ex parte application prayed the judge to grant the temporary order of injunction against the two defendants pending the hearing and final determination of the substantive suit.

According to Guardian, the application dated August 9 was accompanied by a 21-paragraph affidavit of urgency.

However, after carefully listening to the counsel, Justice Mohammed refused to grant the request to stop Kyari’s arrest and extradition through ex parte means.

Rather, he ordered the council to turn the ex parte motion to motion on notice and serve same on NPF and AGF.

The judge also directed the applicant to serve all court processes in respect of the case on the two respondents.
