“It’s Either I Have My Children Or I Go To Jail”: Judy Austin’s Ex-Husband Speaks On N1bn Lawsuit.
Emmanuel Obasi has broken his silence on the N1 billion defamation lawsuit filed against him by his ex-wife, Nollywood actress Judy Austin. In a video that has quickly gone viral, Obasi made it clear that no amount of legal action will stop him from fighting for access to his children.
Obasi began his reaction with a touch of sarcasm, questioning the huge sum mentioned in the lawsuit. “Mr. Obasi has become Central Bank,” he said, laughing. “You sue me one billion. You fit count them? I’m just laughing since yesterday.”
But his mood quickly turned serious as he addressed the main issue driving his public outbursts—his children. “There is nothing I cannot do to have my children. Just mark my word,” he declared firmly.

The businessman pointed to a detail in the lawsuit that he believes works in his favour. According to him, the court papers state that the last time he called Judy was in 2018. “You said it by yourself, you wrote, and I quote, that the last time I called you was 2018. Let it be so,” he said. He then asked a question that has been on his mind for years: “What happened since 2018? Did you block me or not? Why are you hiding my children from me? Why are you manipulating those children?”
Obasi made it clear that he has thought through the consequences of his actions and is ready for whatever comes his way.
“Do you think that lawsuit can scare me away from asking for my children? The answer is no. You don’t know me very well,” he said. “I’m the type of person that, when I determine on something, I determine it in two ways. It’s either I have my children or I go to jail.”
In a striking statement, he revealed that he has already taken practical steps to prepare for the possibility of imprisonment. “I have called my tailor to sow inmate clothes for me with my size, so, in case. I choose it two ways.” He added, “I’m not scared of prison because I have already made up my mind.”

He also questioned the basis of the defamation case against him. “I came out online and said what I experienced and what happened to me, and you say it’s defamation of character. I thought defamation is supposed to be when somebody lies against you, then you can sue the person for defaming you.”
In his response, Obasi also referred to events he says took place during their marriage, including a meeting in Nkpor, Onitsha.
“When I was trying to search for peace and unity in our family, even when I know that I did not wrong you anywhere, did I invite you? You came from Enugu so that we can know how to resolve our issues,” he recounted.
He asked a series of questions that he says confirm his account of their relationship. “Did you travel to Enugu to come to Nkpo to see me? The answer is yes. Did we lodge in Hotel Harrison, New Market Road, Nkpo, second floor? Did we lodge there? The answer is yes. Did we talk about a lot of things and make love, and the next morning we went to Mr Bigg’s to buy some things for our children? The answer is yes.”
He argued that speaking the truth cannot be considered defamation. “What is defamation? When somebody is speaking the truth, you say it’s defaming. So, people will not talk the truth again,” he said.
Obasi ended with a clear warning: “It’s not this time oo. I will be speaking till I put on that clothes and go to jail…”
The legal battle between Obasi and Judy Austin has been brewing for months, following Obasi’s appearance on a podcast where he made several allegations about his former marriage and his relationship with his children . Judy Austin, who is now married to actor Yul Edochie, filed the N1 billion defamation suit, claiming that Obasi’s statements have damaged her reputation .
The lawsuit demands N1 billion in general damages, along with aggravated and exemplary damages, and also seeks an order restraining Obasi from making further statements about her . A lawyer who commented on the matter said Obasi could have approached the court if he had concerns about his children rather than making allegations online .
With Obasi refusing to back down and a N1 billion lawsuit hanging over him, the matter is likely to head to court, where both parties will have the chance to present their evidence. For now, Obasi says he is ready for whatever comes, even if it means wearing prison clothes.
He has drawn a line in the sand and the public is watching to see what happens next.
